These Terms & Conditions explain how you may use this website and the general basis on which Continuum Creative Studio provides creative and digital services. “Continuum”, “we”, “us” and “our” refer to the business operating as Continuum Creative Studio, based in Rockhampton, Queensland, Australia.
For project work, these terms apply only when they are provided to you or linked in a quote, proposal or service agreement and accepted as part of that engagement. Sending an enquiry or booking an introductory call does not commit you to purchase services.
1. Quotes and project agreements
Before paid work begins, we will agree a written scope covering the services, deliverables, fees, payment arrangements and any important exclusions. Your quote or agreement will identify the contracting supplier and any applicable ABN. A specifically agreed project term takes priority over these general terms to the extent of any inconsistency, subject to rights that cannot lawfully be excluded.
Website examples and service descriptions are general information, not an offer to supply a particular package at a particular price. A quote remains available for the period stated in that quote.
2. Services and scope
Our services may include branding and design, websites and landing pages, commercial video and digital content, and digital marketing. Only the work described in your accepted scope is included. Hosting, domains, advertising spend, stock assets, software subscriptions, ongoing maintenance, editable source files and additional revisions are included only where expressly stated.
If requirements change, we will explain any effect on cost, timing or deliverables and obtain your agreement before undertaking additional paid work.
3. Your information, approvals and materials
You are responsible for supplying accurate instructions and providing the content, permissions, access and feedback reasonably needed for the work. You must have authority to provide materials such as logos, photographs, video, customer information and advertising claims. Let us know about any confidentiality, privacy, accessibility, licensing or industry requirements relevant to the project.
We will give you an opportunity to review agreed deliverables. Please check names, contact details, factual claims, prices and other business information before approving publication. Approval does not remove our responsibility for our own work or your statutory rights.
4. Timing and communication
Project dates will be agreed in writing. Estimates depend on timely access, content, feedback and any third-party approvals. If an issue affects the schedule, we will discuss a reasonable revised timeline with you. We do not promise a turnaround time that has not been agreed for your project.
5. Fees and payment
Fees are in Australian dollars unless stated otherwise. Quotes and invoices will state whether GST applies and whether it is included. Any deposit, milestone payment, recurring service or third-party charge must be explained in your accepted quote or agreement.
Unless your accepted quote or agreement specifies a different payment schedule, our default arrangements are:
- Fixed-price projects: 50% of the agreed project fee is payable before work starts. The remaining 50% is payable after you have reviewed and approved the agreed final deliverables, and before public launch or final handover.
- Ongoing marketing services: service fees are payable monthly in advance, before the relevant service period starts. Any minimum engagement period, renewal arrangement or notice requirement must be stated in the accepted agreement.
- Advertising spend: advertising platform charges are separate from our service fees and, unless otherwise agreed, are paid directly by you to the platform within a budget you approve.
We will not take recurring card payments without your authorisation. Payment arrangements remain subject to the cancellation, refund and consumer-rights provisions below.
Pay invoices using the stated method and by the stated due date. We use Stripe for supported invoice and payment processing; other methods may be offered by agreement. Advertising budgets and third-party subscriptions are separate from our fees unless your scope says otherwise. We will not commence a recurring paid service or incur an additional third-party charge without your agreement.
If you dispute an invoice or expect a payment difficulty, contact us promptly so we can discuss it. There are no automatic late fees or cancellation penalties under these general terms.
6. Changes, cancellations and refunds
To change or cancel a project, contact us in writing. For a change-of-mind cancellation, we will assess work actually performed and reasonable, non-recoverable third-party costs that you authorised. We will explain the calculation and refund any unused advance payment after amounts properly payable are accounted for. A deposit is not automatically non-refundable.
If we cannot complete an engagement, we will discuss the available options and refund amounts paid for services we do not supply, subject to any additional remedies available under law. Approved deliverables or useful work already completed will be addressed fairly in that process.
These arrangements do not restrict cancellation, refund, compensation or other rights under the Australian Consumer Law.
7. Australian Consumer Law
Our services carry consumer guarantees where the Australian Consumer Law applies, including guarantees relating to due care and skill, fitness for a disclosed purpose where applicable, and supply within a reasonable time where no time is fixed. These rights cannot be excluded by these terms.
If a service fails to meet an applicable guarantee, you may be entitled to a remedy such as rectification, cancellation, a refund or compensation, depending on the circumstances and seriousness of the failure. Contact us so we can assess and resolve the issue. Nothing in these terms excludes, restricts or modifies a right, guarantee or liability that cannot lawfully be excluded, restricted or modified.
8. Intellectual property and licences
You retain rights in materials you supply. You give us permission to use those materials as reasonably necessary to carry out your project.
Your written agreement will explain ownership, licensing and the files to be delivered. Unless a different arrangement is agreed in writing, once the relevant fees are paid you receive an ongoing, non-exclusive licence to use, reproduce and adapt the final custom deliverables for the business purposes agreed for the project, including through another service provider. An assignment of copyright must be expressly agreed in writing.
Pre-existing tools, templates, methods, software, fonts, stock content and other third-party materials remain subject to their existing ownership and licence conditions. Editable working files, unused concepts and production files are supplied only where agreed. We will identify material third-party licensing requirements relevant to your intended use.
9. Creative tools and demonstrations
We may use software, stock assets and AI-assisted tools in creative production. Where relevant, we will discuss their use, licensing considerations and any limitations affecting your intended deliverables. AI-assisted elements may not be unique or capable of exclusive protection. Any requirement for exclusive rights, trademark clearance or particular production methods should be agreed before work begins.
Projects identified as demonstration builds or illustrative brands show creative approaches. They are not representations of commissioned client work, actual campaign performance or verified commercial results.
10. Marketing outcomes and third-party platforms
We do not guarantee search rankings, AI-search placement, advertising approval, a particular number of leads or a revenue result. Outcomes depend on factors including your offer, budget, competition, market conditions and third-party platform decisions. This does not reduce our obligation to perform agreed services with appropriate care and skill or to meet an express commitment in your contract.
Google, Meta, hosting providers, payment platforms and other third parties have their own terms and policies. We cannot control their outages, policy changes or account decisions. We will explain material dependencies known to us and discuss practical options if they affect your project.
11. Confidentiality and portfolio use
Both parties should protect non-public business information shared for a project and use it only for the engagement, except where disclosure is authorised, reasonably necessary to an appropriate service provider, or required by law. Our handling of personal information is explained in the Privacy Policy.
We will obtain your permission before identifying you as a client or displaying your project in our portfolio. Confidential information will not be published merely because we worked on it.
12. Website use
You may browse this website and share links for legitimate purposes. Do not interfere with its operation, submit unlawful or misleading content, attempt unauthorised access, or reproduce our branding and portfolio materials as your own. You may use material where permitted by law or with the relevant rights holder’s permission.
Links to other websites are provided for convenience. Their operators are responsible for their own content and services.
13. Concerns and disputes
If you have a concern, contact Chris with your project details, the issue and the outcome you are seeking. We will acknowledge it and work with you towards a reasonable resolution. You remain free to seek help from an appropriate regulator, tribunal or court; an internal complaint process is not a condition for exercising a statutory right.
14. Governing law and updates
Queensland law and applicable Commonwealth law govern these terms, subject to any mandatory rights or jurisdiction that apply to you. These terms do not require you to give up a forum or protection available under applicable law.
We may update these website terms by publishing a new version with its date. Changes apply prospectively and do not retrospectively alter an existing project agreement without the parties’ agreement.
